When purchasing a dwelling, the purchase procedure and scope of our services will differ depending on whether our clients (1) decide to purchase a ready-made and existing dwelling, or (2) to purchase a dwelling that will be built within a certain period of time, as part of the construction carried out by a selected construction company that offers such premises as part of a prepared or already ongoing investment.
In the case of variant (1), our client concludes an agreement with us, on the basis of which we conclude a reservation agreement under which the seller undertakes not to sell the premises chosen by our client to another person.
The conclusion of such an agreement and taking actions by us will require a payment to the account of our Company of an initial fee*, half of which will be paid to the Seller (this amount will be credited towards the sale price in the event of a sale agreement being concluded, and in the event of failure to conclude of the sales contract specified in the reservation contract due to the fault of our client will be subject to retention by the Seller), the remaining half will be credited by our Company as remuneration for brokerage services and preparation of the entire sale transaction. The remuneration of our Company is described further in our Terms and Conditions.
After making the payment of the amount specified above and concluding the reservation agreement, our client will receive from us a model power of attorney allowing us to represent him by our Company in the sale agreement and purchase real estate on his behalf and for his benefit.
The real estate sale agreement must be concluded, otherwise null and void, in the form of a notarial deed.
A person residing outside the EU may grant a power of attorney before a foreign notary. In order to be able to use a power of attorney in Poland in the form of a foreign notarial deed, this notarial deed must be provided with an apostille clause (if the country granting it is a party to the Hague Apostille Convention) or it will be subject to the legalization process by the Polish Consul in a given country. The entire process is prepared and carried out by our Company as part of the real estate purchase transaction support services provided to our clients, including translation by a sworn translator.
After receiving the power of attorney, our Company prepares or negotiates the content of the sales contract and provides the customer with the bank account number on which the remaining part of the sale price should be deposited as well as notary fees and other fees charged to our customer as the Buyer). The funds should reach the notary's bank account at least 7 days before the date of the planned sale transaction. The money is secured on the deposit account of the notary who in Poland serves as a public official and is a profession of social trust. The funds from this deposit bank account will be transferred only to the Seller and only after the conclusion of the real estate sale agreement. On the day of concluding the contract of sale, the notary public sends an electronic application to the authority maintaining the real estate register to change the person of the property owner to the data of our client.
